prevention of social housing fraud act 2013 comes into force


The act came into force on 15 October 2013 after signing of the commencement order.

The key provisions of the Act are:

  • Assured tenants will lose their security of tenure if they have sub-let their property.
  • Social landlords can seek a judgement against tenants in respect of any unlawful profits.
  • Two new criminal offences that could lead to a fine or up to 6 months imprisonment.
  • The Secretary of State and Welsh Ministers are given the power to make regulations to compel persons to provide information for the purpose of housing fraud investigations.
