CIFPA Stats+ terms and conditions of service

The Chartered Institute of Public Finance and Accountancy (CIPFA) collates annual surveys of local authority operations in order to provide managers of the services so surveyed with information about how their activities compare with operations in similar organisations. The surveys comply with a code of conduct designed to protect the independence and impartiality of this process. Users of this data are requested to observe certain terms and conditions in order to uphold the trust authorities place in supplying the data for responsible interpretation and use.

1 Terms and conditions

These additional terms and conditions must be read with the website terms and conditions and the general terms and conditions of sale available on our website. By using our website you confirm that you have read, understood and agree to the relevant terms and conditions. If you do not agree to all the relevant terms and conditions in their entirety, you must not use our website or order any product or service through the website.

2 Service provision

The management and administration of this service is provided by CIPFA Business Ltd, the trading subsidiary of the Chartered Institute of Public Finance and Accountancy (CIPFA). Access to the data products and associated services is provided via cipfastats.net or analytics.cipfa.org.

3 Commencement and term

The service will be provided on an annual subscription basis; the subscription period will start on 1 April and end on 31 March the following year. Payment for the subscription will be due on presentation of a valid invoice.

4 Subscription renewal

An organisation accepting a subscription renewal will be deemed to have accepted the terms of the service level agreement as set out in this schedule.

The ongoing subscription will be automatically renewed on 1 April each year unless prior notification of cancellation is received in accordance with the cancellation terms below.

5 Cancellation

Should you wish to cancel your subscription renewal you must do so by giving one month's notice in writing or by email before the next subscription start date. A subscriber may cancel their subscription mid-term but fees are not returnable.

If CIPFAstats does not receive details of the intention to cancel a subscription, at least one month before the start date of the next subscription period, the subscription will automatically be renewed and the subscribing organisation will be liable for the full subscription fee for the new period.

6 Subscription fees

Subscription fees will be subject to an annual price review. All online subscription fees will be subject to VAT charged at the UK standard rate.

7 Nominated contacts

For liaison purposes each subscribing organisation should nominate a contact point for any queries concerning this subscription.

8 Copyright and users' rights

All copyrights, database rights and design rights subsisting in any data provided pursuant to this agreement, through cipfastats.net or analytics.cipfa.org shall vest absolutely in CIPFA. All information provided is the copyright of CIPFA.

These statistics are confidential information and for internal use only within the subscribing organisation. External disclosure of data or analysis without permission will give rise to an actionable breach of confidence.

Any analysis that incorporates data from the CIPFA statistical publications or website must not be published or presented to a third party, without prior written permission from CIPFA. Reproduction of CIPFA data may result in a further charge being incurred. Please contact cipfastatssub@cipfa.org or phone 020 7543 5600 to request use of data for this purpose.

9 Service entitlement

The subscription is deemed to be with the employing organisation of which any member of their staff may download and distribute the data to and for analysis by any other staff employed by that organisation. Where such data are processed by sub-contractors or associates, the data may not be used for purposes other than work for the subscribing organisation.

Service provision is made available only to established employees and elected members of a single purchasing local authority. Terms for other categories of user, which includes those local authorities operating shared service arrangements, are available from CIPFA on request.

The data obtained during the period of the subscription may not be used in a succeeding period, unless the subscriber organisation renews the subscription. (In the event of the price of this subscription increasing, the renewal subscription may be purchased at the original price providing further online access to more recently compiled data is terminated)

Your subscription service entitlement is as stated on the enclosed subscription information sheets. While every effort will be made CIPFA cannot guarantee that the website and any associated services will remain uninterrupted or be error free.

Providing CIPFA with your information indicates that you agree to use processing your personal information for relevant targeted communications to you promoting our services. 10 Liability

Although every effort is made to ensure the accuracy of information provided on our website and in the publications, CIPFA accept no responsibility or any liability for any damages, third party claims, or any future costs pursuant to relying on the information provided.

11 Quality assurance

CIPFA prides itself on the quality of the services it provides. The survey analysts undertake reasonable validation checks on the data which are taken to represent the reported activity or expenditure in accordance with the definitions of the survey questionnaires.
