This briefing paper considers the case, Winder & Ors, R (on the application of) v The Equality and Human Rights Commission [2014] EWHC 2617 (Admin),which was brought by the Child Poverty Action Group (CPAG) against Sandwell Council, which, since April 2013, has had a policy of excluding anyone from claiming a reduction in council tax unless they had continuously lived in the area for two years or more regardless of their ability to pay.
